In place of a standard consultation response, we have submitted a letter to the Ministry of Housing, Communities and Local Government addressing its consultation on quid pro quo leases and the ground rent cap.
Our letter challenges the misconceptions underpinning the consultation, particularly the suggestion that only leases falling within its proposed narrow definition should be treated as quid pro quo leases. This is contrary to the Government’s own previous evidence. We also explain why the proposed definition and evidentiary requirements would be unworkable in practice, and why capping even exempt ground rents after 40 years would be fundamentally at odds with the Government’s wider position on ground rents.
